Terms of Service for Kebab Empire Tycoon

1. Acceptance of Terms
Welcome to Kebab Empire Tycoon (the “App”)! These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Mert Celik (“we,” “us,” or “our”) regarding your use of the App.
By downloading, installing, or using the App, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not access or use the App.
2. Eligibility
Age Requirements
- You must be at least 13 years old to use the App
- If you are under 18 years old, you must have parental or guardian consent to use the App
- If you are under 13 years old, you are NOT permitted to use the App
Account and Device
- No user account is required to play the App
- You are responsible for maintaining the security of your device
- You must use a compatible iOS or Android device
3. License to Use the App
Grant of License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the App on your personal device(s)
- Use the App for your personal, non-commercial entertainment purposes
License Restrictions
You agree NOT to:
- Modify, reverse engineer, decompile, or disassemble the App
- Copy, distribute, or create derivative works from the App
- Remove or alter any copyright, trademark, or proprietary notices
- Use the App for any commercial purpose without our written consent
- Use cheats, exploits, automation software, bots, hacks, or mods
- Attempt to gain unauthorized access to the App or its servers
- Interfere with or disrupt the App or servers
- Use the App in any way that violates any applicable law or regulation
4. Game Currency and Virtual Items
Virtual Currency
The App includes virtual currency called “Gems” and “Coins” (collectively, “Virtual Items”):
- Coins: Earned through gameplay, used for in-game purchases
- Gems: Earned through gameplay or purchased with real money, used for premium features
- Angels: Earned through prestige, provide permanent bonuses
No Real-World Value
Virtual Items:
- Have NO real-world monetary value
- Cannot be exchanged for real money or anything of value
- Cannot be transferred or sold to other users
- Are not your property; we retain all rights to Virtual Items
Loss of Virtual Items
We are NOT liable for any loss of Virtual Items due to:
- Account deletion or suspension
- Device loss, damage, or upgrade
- App malfunction or bugs
- Server maintenance or downtime
- Termination of the App
Important: We recommend enabling device backups (iCloud for iOS, Google Drive for Android) to preserve game progress, but we cannot guarantee restoration.
5. In-App Purchases
Purchase of Virtual Items
You may purchase Virtual Items (Gems packages) using real money through:
- Apple App Store (iOS devices)
- Google Play Store (Android devices)
All purchases are:
- Processed by Apple or Google (not by us)
- Subject to their respective payment terms and policies
- Final and non-refundable (unless required by law)
Pricing and Payment
- Prices are displayed in your local currency
- Prices are subject to change without notice
- Payment will be charged to your Apple ID or Google Play account
- Sales tax may apply depending on your location
Refund Policy
All sales are final. We do NOT offer refunds for:
- Virtual Items successfully delivered
- Accidental purchases
- Unused Virtual Items
- Dissatisfaction with Virtual Items
Exceptions:
- Technical errors preventing delivery (contact us immediately)
- Unauthorized purchases by children (contact Apple/Google within 48 hours)
- Required by applicable law

6. VIP Subscriptions
Subscription Tiers
The App offers VIP subscription tiers with premium benefits:
- VIP Weekly: 7-day subscription
- VIP Monthly: 30-day subscription
- VIP Yearly: 365-day subscription
Subscription Benefits
VIP subscribers receive:
- Increased offline earnings cap
- Faster production rates
- Exclusive prestige perks
- Daily gem rewards
- Ad-free experience (optional benefit)
- Other premium features as specified in the App
Auto-Renewal
Subscriptions automatically renew unless canceled:
- Renewals are charged 24 hours before the current period ends
- Subscription period is extended by the renewal period
- Renewal price may change; you will be notified in advance
Managing Subscriptions
You can manage and cancel subscriptions through:
- iOS: Settings → [Your Name] → Subscriptions
- Android: Play Store → Menu → Subscriptions
Cancellation:
- You can cancel anytime (at least 24 hours before renewal)
- Access to VIP benefits continues until the end of the current period
- No partial refunds for unused time
7. Advertising
Ad-Supported Gameplay
The App displays advertisements provided by Google AdMob:
- Banner ads, interstitial ads, and rewarded video ads
- Ads may be personalized based on your interests (with your consent)
- Ad frequency is controlled to minimize disruption
Rewarded Ads
You may voluntarily watch rewarded video ads to receive in-game bonuses:
- Watching ads is optional
- Rewards are delivered upon successful ad completion
- We are not responsible if ads fail to load or rewards fail to deliver
Third-Party Ad Content
- We do NOT control the content of third-party ads
- Advertisers are responsible for their ad content
- Clicking ads may redirect you to external websites (use caution)
Removing Ads
You can remove ads by:
- Purchasing the “Remove Ads” in-app purchase (one-time payment)
- Subscribing to VIP (ad-free benefit included)
8. User Conduct
Prohibited Activities
You agree NOT to:
- Use cheats, hacks, mods, or exploits to gain unfair advantages
- Attempt to manipulate game mechanics or Virtual Item acquisition
- Reverse engineer or extract game assets
- Create multiple accounts to exploit free rewards
- Engage in fraudulent in-app purchases or chargebacks
- Harass, abuse, or harm other users (if multiplayer features exist)
- Use offensive or inappropriate usernames (if applicable)
- Violate any applicable laws or regulations
Consequences of Violations
We reserve the right to:
- Suspend or terminate your access to the App
- Remove or reset your game progress
- Confiscate Virtual Items obtained through violations
- Report illegal activities to law enforcement
- Take legal action for damages
9. Intellectual Property Rights
Our Ownership
All rights, title, and interest in and to the App, including but not limited to:
- Game design, graphics, artwork, music, and sound effects
- Source code, algorithms, and software
- Trademarks, logos, and branding (“Kebab Empire Tycoon”)
- Virtual Items, game content, and updates
are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.
User-Generated Content
Currently, the App does NOT support user-generated content (e.g., custom levels, chat, profiles).
If we add such features in the future:
- You grant us a worldwide, perpetual, royalty-free license to use your content
- You represent that you own or have rights to the content
- We may remove content that violates these Terms
Trademarks
“Kebab Empire Tycoon” and related marks are our trademarks. You may not use our trademarks without our prior written consent.
10. Updates and Changes to the App
App Updates
We may release updates to the App:
- To add new features, content, or improvements
- To fix bugs, errors, or security vulnerabilities
- To comply with platform requirements or legal obligations
Updates may:
- Require download and installation
- Change game balance, features, or Virtual Item values
- Remove or modify existing features
Mandatory Updates
Some updates may be mandatory to continue using the App. Failure to update may result in loss of access.
Changes to Virtual Items
We reserve the right to:
- Modify the attributes, pricing, or availability of Virtual Items
- Add or remove Virtual Items
- Adjust game balance and economy
We will provide notice of significant changes when possible.
11. Termination
Termination by You
You may stop using the App at any time by:
- Uninstalling the App from your device
- Deleting your game data
Note: Uninstalling the App does NOT automatically cancel subscriptions. You must cancel subscriptions separately through your App Store/Play Store account.
Termination by Us
We reserve the right to terminate or suspend your access to the App:
- For violation of these Terms
- For fraudulent or illegal activity
- For abusive or harmful behavior
- At our sole discretion, with or without notice
Effect of Termination
Upon termination:
- Your license to use the App ends immediately
- You must stop using the App and delete all copies
- All Virtual Items and game progress may be lost
- Active subscriptions will continue until the end of the current period (no refunds)
12. Disclaimers
“As-Is” Basis
THE APP IS PROVIDED “AS-IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability or fitness for a particular purpose
- Warranties of non-infringement
- Warranties that the App will be uninterrupted, error-free, or secure
No Guarantees
We do NOT guarantee that:
- The App will meet your expectations
- The App will be free of bugs, viruses, or malware
- Virtual Items will always be available or retain their value
- Game progress will be preserved across device changes
- Third-party services (Apple, Google, Firebase, AdMob) will function correctly
Third-Party Services
We are NOT responsible for:
- App Store or Play Store policies, outages, or billing issues
- Google AdMob or Firebase service disruptions
- Third-party websites linked from ads
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
No Consequential Damages
WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits or revenue
- Loss of data or Virtual Items
- Loss of goodwill or reputation
- Business interruption
- Personal injury or emotional distress
Maximum Liability Cap
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE APP SHALL NOT EXCEED THE GREATER OF:
- $100 USD, OR
- The amount you paid us (if any) in the 12 months preceding the claim
Exceptions
Some jurisdictions do not allow limitations on certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
14. Indemnification
You agree to indemnify, defend, and hold harmless us, our affiliates, and our respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Your fraudulent or illegal activities
15. Dispute Resolution
Governing Law
These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law principles.
Jurisdiction
Any legal action or proceeding arising out of or related to these Terms or the App shall be brought exclusively in the courts of Turkey, and you consent to the jurisdiction of such courts.
Before filing a legal claim, you agree to attempt to resolve the dispute informally by contacting us at celik.merthasan58@gmail.com with a detailed description of the dispute.
We will attempt to resolve the dispute within 30 days.
Arbitration (Optional)
If informal resolution fails, you may choose binding arbitration:
- Arbitration will be conducted in Turkey
- Arbitration will be conducted in English or Turkish
- Each party will bear its own costs
No Class Actions
YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
All disputes must be resolved on an individual basis.
16. Changes to These Terms
We reserve the right to modify these Terms at any time.
Notification of Changes
We will notify you of material changes by:
- Posting the updated Terms in the App
- Updating the “Last Updated” date at the top
- Displaying an in-app notification (for significant changes)
Acceptance of Changes
Your continued use of the App after changes become effective constitutes your acceptance of the updated Terms.
If you do not agree to the updated Terms, you must stop using the App.
17. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements and understandings.
